This Privacy Policy of y-Link applies to the processing of your personal information (‘Personal Data’) by Yokogawa Electric Corporation, a corporation duly organized and existing under the laws of Japan with its principal place of business at 9-32, Nakacho 2-chome, Musashino-shi, Tokyo, Japan (‘Yokogawa’).

1. Processing of your Personal Data
  1. Yokogawa collects and processes the Personal Data, which you provide us on the application form of the y-Link membership, to provide the services set forth herein below (‘Services’). By registering to the y-Link, you as a user will become subject to the terms and conditions of the Terms of y-Link.
  2. Yokogawa requires the Personal Data to provide the following Services (‘Purpose’):
    • Providing product-related information, documents and software for product lifecycle management
    • Supporting your inquiries
    • Delivering email newsletters (including, for marketing purpose) if you separately expressly agreed (Option: See below)
    At any time, you may change your choice of being either subscribe or unsubscribe to the newsletters in the Update Member Information of the y-Link. Even if you choose to unsubscribe to the newsletters, you can still use the Services (except for the newsletters) in the y-Link, but we would need to use your email address for communicating important matters such as change of terms and conditions of the Terms of y-Link.
  3. The y-Link is making use of web analytics tools, which analyze your activity within the y-Link in order to improve our services. At any time, you can opt out of the tracking by changing the settings of your browser in case your current browser setting allows us to track.
  4. Unless Yokogawa receives any delete requests by email or through the interface that allows you to delete your account through the y-Link, Yokogawa will use and retain the Personal Data until we confirm the termination of membership. Yokogawa shall remove the Personal Data after that period, unless it is legally obligated to retain it for a longer period.
2. Share of the Personal Data
  1. For the purpose of subcontracting a part of processing of the Personal Data for the Purpose, the Personal Data could be shared with Amazon Web Services, Inc.. Amazon Web Services, Inc. may be located outside of your region / country of origin and located in a region / country, which may not have been determined from your region /country’s authorized agency as having an adequate level of protection.
  2. Furthermore, Yokogawa may also disclose the Personal Data if we believe that the disclosure is required by law, or is in response to a legal request.
3. Your rights in relation to our processing of the Personal Data
  1. You have the right to request to have it corrected or deleted, unless Yokogawa is legally required to retain it. These rights can be exercised by you in the Update Your Account of the y-Link.
    You have also the right to access to the Personal Data as processed by us, to restrict our processing of the Personal Data or to object to such processing. These rights can be exercised by sending email to <y-link@cs.jp.yokogawa.com>.
    If you have any question regarding your rights mentioned above, please email a request to <y-link@cs.jp.yokogawa.com>. Notwithstanding the foregoing, Yokogawa may reject your requests that are manifestly unfounded or excessive, in particular because of their repetitive character.
  2. If you are concerned about the compliance of your legal rights in relation to your privacy, you may also contact your local privacy data protection authority.
4. Lawful Bases for Processing
  1. Yokogawa will only process the Personal Data where we has lawful bases. Lawful bases include (a) your consent (for delivering email newsletters in accordance with 1.2 above), (b) where Yokogawa needs the Personal Data to perform a contract with you (necessary for provision of the Service you request) and (c) where the processing is in Yokogawa’s or a third party’s “legitimate interests”.
    We may process Personal Data for the purposes of our legitimate interests or for the legitimate interests of third parties (e.g., your employer or company), provided that such processing shall not outweigh your rights and freedoms. For example, Yokogawa may process your Personal Data to:
    • Protect you, us, or others from threats (such as security threats or fraud)
    • Provide and manage the Service
    • Understand and improve our business or customer relationships generally
    • Enable us and you to connect with each other, find jobs and economic opportunity, express opinions, exchange information, and conduct business
    • Comply with laws that apply to us
  2. Where Yokogawa relies on your consent to process Personal data, you have the right to withdraw or decline your consent at any time and where Yokogawa relies on legitimate interests, you have the right to object.
5. Change
  1. Yokogawa can modify this Privacy Policy, and if Yokogawa makes material changes to it, we will provide notice through the Services, or by other means, to provide you the opportunity to review the changes before they become effective. If you object to any changes, you may close your account.
  2. You acknowledge that your continued use of the Services after Yokogawa publishes or sends a notice about our changes to this Privacy Policy means that the collection, use and sharing of Personal Data is subject to the updated Privacy Policy.
